Construction of a proposed data center on federal land near Boulder City is on hold after an administrative judge ruled Tuesday in favor of the city and environmental groups.
The Interior Board of Land Appeals granted a stay while an appeal of the project is processed.
Judge David Gunter said the B-L-M improperly relied on an environmental review for a solar project to approve the data center, writing that the two projects are “fundamentally dissimilar.”
The developer, Townsite Solar Two, says it respects the decision and will continue working with the B-L-M and Boulder City.
The proposed facility would require 167 megawatts of power — more than three times Boulder City’s peak demand.

Meanwhile, Storey County, home to the sprawling industrial park east of Reno, submitted a sweeping proposal to the Nevada Legislature on Tuesday to shorten the length of tax incentives, impose stricter spending requirements and prohibit tax breaks for data centers located on federal land. It would also require more public disclosures on water and energy use and give some local governments greater power to reject a tax break.
The Nevada Independent reports this morning that the proposal comes 11 years after the Nevada Legislature launched its data center tax break program in an effort to woo data center company Switch to Storey County. There are 76 data centers built or planned in Nevada, according to the online tracker Data Center Map.
The state has given out $461 million in expected tax breaks to data centers — and three-quarters of that money has gone to developments in Storey County. The county supported the creation of the program, but the proposal indicates that even it believes changes are necessary.

Two arrests highlight the Monday White Pine County Sheriff’s Office blotter.
Thirty-nine-year-old Anthony Apodaca-Buckner of Ely was arrested on an Ely Municipal Court warrant. No bail was listed.
And 41-year-old Lucien Leflohic of Ely was arrested following a traffic stop on a warrant out of the Fifth Judicial District Court in Nye County. Bail was set at five thousand dollars.
Deputies also investigated reports of a stolen cellphone at a local casino, damage to a business, and an attempted fraud involving someone being asked to mail gift cards.
Two trespassing complaints were reported, along with several juvenile-related incidents, including alleged harassment and a report of an intoxicated juvenile driving. The juvenile cases were forwarded to Juvenile Probation.
Deputies also handled reports of a reckless driver, lost property, and a welfare check.
The White Pine County School Board approved its district performance plan Tuesday night, along with several personnel changes and a transportation contract.
The board also approved a process for screening applicants for an open board position, with four or more applicants triggering a committee review.
Meanwhile, plans for the district’s new school remain on schedule. The preliminary construction estimate is now about 112-million dollars, with the bond sale closing expected November fifth.
District officials also reported that fiscal-year closeout and preparations for the annual audit are underway.
Two men are under arrest after police say shots were fired during an argument at a Wells gas station early Monday morning.
Elko County sheriff’s deputies responded to the Golden Gate fuel station just after one A-M, following reports that a man fired a gun in someone’s direction.
Police say the two suspects then left the area and went to the Flying J after allegedly stealing four cases of beer.
Deputies and Nevada Highway Patrol troopers stopped the vehicle and arrested Hayden Young and Atticus Kallsen.
Young faces multiple firearm and assault charges, along with DUI, petit larceny and hit-and-run. Kallsen faces alcohol possession and petit larceny charges.
Nevada’s top elections official is raising concerns about a new federal system for delivering mail-in ballots ahead of the November midterms.
Secretary of State Cisco Aguilar says he fears the system could disenfranchise voters. A whistleblower report alleges the Postal Service is rushing to build a database that will verify mail-ballot recipients, and warns a single scanning error could potentially prevent an entire batch of ballots from being delivered.
Nevada is particularly affected because 47 percent of votes were cast by mail in the 2024 election.
The Trump administration says the new system is designed to protect election integrity. Nevada officials are exploring alternatives, including private carriers, if the Postal Service system proves unreliable.
